The first subject under study is “betterment right discussion. The following definition is offered for betterment right : It is a right given to the municipalities based on which they can take a sum of money from real estate owners due to increased price of their properties as a result of construction, development, restoration and widening of routes and squares performed by the municipality; the payment amount and mechanism and the properties obligated to pay this charge are determined by law. The betterment right issue has underwent lots of modifications either religiously (in jurisprudence context) or legally as there used to be an statute before Islamic Revolution having the same conditions entitled “Statute of Quality-Improvement Right which was revoked after the Revolution by Imam Khomeini’s fatwa. Subsequently, the Ministry of Interiors in 1991 considered it as a sort of tolls based on a fatwa by the Supreme Leader and again created this right for the municipalities under certain circumstances. Comparatively, the Statute of Quality-ImprovementRight had been codified more rigorously than the BettermentRight Law. The other subject in the present research is the discussion of separation and partitioning of urban lands.  The first legislation case in this regard is Municipality Law ratified in 1966, which was revised in 1972 and 1986 respectively in “Establishment Law of Supreme Council of Urban Development and Architecture” and reformation of “Registry Law”. And ultimately, clause 101 of Municipality Law was revised in 2011, which is regarded as the last legislation measure in this respect. Separation (of lands) is defined as follows: separating and fragmenting the lands into smaller pieces and specifying the use of each piece of land. The following definition is proposed for “partitioning”: separating the shared equity of each partner, or in other words, partitioning signifies dividing the shared immovable property among the partners proportional to their shares. The laws ratified concerning separation and partitioning of lands were compared in the current dissertation. Last but not the least, the last legislation case in this regard (the revised clause 101) was depicted. The respective clause incorporates more extensive items technically compared to the former laws, regarded as an advantage. Expectedly, however, the same clause has left many legal issues unanswered, which is a shortcoming from this aspect.}, keywords = {Estate added Value,Betterment Right,Improvement Right,Seprationand Partition}, title_fa = {ارزش افزوده املاک در عملیات عمرانی شهری از منظر فقه و حقوق ایران}, abstract_fa = {  هدف از این مقاله این است که بتوانیم دو موضوع مهم و کاربردی در قانون شهرداری­ها را بررسی کنیم. اولین موضوعی که مورد بررسی قرار گرفته، بحث حق مرغوبیت و حق تشرف است، تعریفی که از حق تشرف ارائه شده چنین است: حق تشرف آن حقی است که به شهرداری­ها داده شده که مبلغی را از برخی از املاک بگیرند بابت افزایش قیمتی که این املاک پیدا می ­کنند بر اثر ساخت، توسعه، اصلاح و گسترش راه­ها و میادینی که توسط شهرداری انجام گرفته و میزان و نحوۀ پرداخت آن و همچنین اینکه چه املاکی موظف به پرداخت می­ باشند را قانون تعیین می­ کند.مبحث حق تشرف چه از لحاظ فقهی و چه از لحاظ حقوقی دارای افت و خیزهای بسیاری است، چراکه پیش از انقلاب آیین نامه ای همین شرایط به نام آیین نامۀ حق مرغوبیت وجود داشت که بعد از انقلاب بر اساس فتوای حضرت امام (ره) این آیین نامه نسخ شد؛پس از آن وزارت کشور در سال 70 بنا بر فتوایی که از مقام معظم رهبری دریافت نمود، آنرا نوعی عوارض تلقی کرده و با شرایطی خاص دیگر بار این حق را برای شهرداری بوجود آورد. اما در بحث دیگر یعنی تفکیک و افراز اراضی شهری اولین ارادۀ قانون­گذار در بحث تفکیک و افراز، مادۀ 101 قانون شهر­داری­ها مصوب اسفند 1345 بود تا سال 1345 که قانون اصلاح پاره­ای از مواد و الحاق چند ماده به قانون شهرداری از تصویب گذشت و همزمان با آن نیز کار تهیه طرح ­های جامع شهری در ایران رونق گرفت، پیش از این سیاست تفکیک و تعیین نوع استفاده از زمین بطور دربست در اختیار شخص مالک بود، گام مهم بعدی ماده 154 اصلاحی قانون ثبت مصوب1365/4/31 به مدت 25 سال آخرین ارادۀ قانون­گذاری در بحث تفکیک و افراز بود، این سیر ادامه داشت تا اینکه در سال 1390 قانون­گذار، اصلاحیه­ای بر قانون شهرداری­ها گذاشت که بطور کلی تمام قوانین قبلی را نسخ نمود، این اصلاح مربوط به مادۀ 101 قانون شهرداری­ها بود که در واقع آخرین ومفصل­ترین ارادۀ قانون­گذار در بحث تفکیک و افراز می ­باشد و در این مقاله نظر بر این است که مباحث تفکیک و افراز به طور جامع مورد بررسی قرار گیرد}, keywords_fa = {ارزش افزوده املاک,حق تشرف,حق مرغوبیت,تفکیک,افراز}, url = {https://journal.shiraz.ir/article_81372.html}, eprint = {https://journal.shiraz.ir/article_81372_94c4a433f68846eb4078fd73e857e24d.pdf} }
